A2P Messaging Compliance
At text2order.app, we take messaging compliance seriously. Our platform uses Application-to-Person (A2P) messaging to enable restaurant ordering via SMS. This page outlines our compliance with industry regulations and best practices.
What is A2P 10DLC?
A2P 10DLC (Application-to-Person 10-Digit Long Code) is a messaging framework that allows businesses to send high-volume SMS messages to customers using a standard 10-digit phone number. This framework requires registration and compliance with carrier regulations to ensure message deliverability and protect consumers from unwanted messages.
Our Compliance Measures
- Brand Registration: text2order.app is properly registered with mobile carriers through our messaging provider to ensure transparent communication.
- Campaign Registration: Our messaging campaigns are registered with appropriate use cases and accurate volume projections.
- Opt-In Consent: We only send messages to customers who have explicitly opted in to receive communications from your restaurant.
- Clear Identification: All messages clearly identify the sending restaurant and the purpose of the communication.
- Opt-Out Mechanism: Every message thread includes information on how to opt out of future communications.
- Message Content: We ensure all messages comply with CTIA and carrier guidelines regarding prohibited content.
Customer Consent Requirements
For restaurants using our platform, we implement a customer-initiated communication model with the following consent practices:
- Customer-Initiated Communication: Our service operates on a customer-first model where the customer initiates the conversation by texting the restaurant's text2order number to place an order. This initial text from the customer serves as explicit consent to engage in the ordering process.
- Clear disclosure that customers will receive SMS messages when they provide their phone number
- Explicit opt-in mechanism before sending any marketing messages beyond the initial order conversation
- Maintenance of consent records including timestamps of customer-initiated conversations
- Immediate processing of opt-out requests
- Respect for customer communication preferences throughout the entire interaction
Privacy and Data Protection
text2order.app is committed to protecting customer data in compliance with applicable privacy laws. We:
- Only collect necessary information for order processing
- Implement industry-standard security measures to protect customer data
- Do not sell or share customer contact information with third parties
- Retain data only for the period necessary for business operations and compliance
Billing and Payment Processing
text2order.app does not handle payment processing directly. All billing is managed by the restaurant's existing Point of Sale (POS) system. This approach:
- Maintains the security of customer payment information within established POS systems
- Ensures compliance with payment card industry (PCI) standards through the restaurant's existing payment infrastructure
- Provides a seamless integration with the restaurant's current financial reporting and reconciliation processes
- Allows customers to maintain their existing payment relationship with the restaurant
Carrier Compliance
Our messaging infrastructure complies with requirements from all major U.S. carriers including AT&T, T-Mobile, and Verizon. We continuously monitor and adapt to changing carrier requirements to ensure high deliverability rates.
TCPA Compliance
The Telephone Consumer Protection Act (TCPA) regulates telemarketing calls, auto-dialed calls, and text messages. text2order.app helps restaurants maintain TCPA compliance by:
- Requiring express written consent before sending marketing messages
- Maintaining records of consent
- Honoring opt-out requests promptly
- Sending messages only during allowed hours
